　　外资已经成为北京市开放型经济发展的重要力量。11月22日，北京商报记者在北京市第十六届人大常委会第六次会议上获悉，当前，受全球产业链供应链加速调整影响，外资投资形势出现了新的变化，为推动更高水平对外开放、积极促进外商投资、保护外商投资合法权益、规范外商投资管理、构建全面开放新格局、推动首都高质量发展，北京市人民政府向市人大常委会提请审议《北京市外商投资条例（草案）》，将主要在投资准入、投资促进、投资保护、投资管理、投资便利、投资服务上更进一步。

　　加大政策力度

　　进一步补充细化

　　为贯彻落实党中央国务院促进外商投资决策部署和《中华人民共和国外商投资法》及其实施条例的需要，在北京市第十六届人大常委会第六次会议上，北京市司法局局长崔杨表示，有必要通过地方立法，在外商投资的准入、促进、保护、管理、便利和服务等方面，进一步补充、细化上位法规定，以法治推进更高水平对外开放。

　　近年来，外资已经成为首都开放型经济发展的重要力量。据悉，“十三五”期间，北京市实际利用外资累计796亿美元，占全国比重超11.8%；2022年北京市实际利用外资174.1亿美元，按可比口径同比增长12.7%，高于全国增速4.7个百分点。

　　当前，世界百年未有之大变局加速演变，全球范围内产业链供应链加速调整，外商投资形势也出现了新的变化。对此，崔杨指出，有必要坚持问题导向开展地方立法，发挥首都城市战略定位、“两区”建设优势，对标国际高标准经贸规则，深化商品和要素流动型开放，扩大规则、规制、管理、标准等制度型开放，为构建首都开放型经济新体制提供法治保障。

　　在综合各方面意见的基础上，经过反复修改完善，北京市人民政府向市人大常委会提请审议《北京市外商投资条例（草案）》（以下简称“草案”）。据悉，草案共9章43条，分为总则、投资准入、投资促进、投资保护、投资管理、投资便利、投资服务、法律责任、附则。

　　北京市人大常委会民宗侨外办公室相关负责人表示，草案能与《关于进一步优化外商投资环境加大吸引外商投资力度的意见》等重要文件形成有效衔接，有利于深入贯彻落实中央和市委的相关决策部署，大力推进本市制度型开放；严格落实上位法规定，积极对标国际高标准经贸规则；高度关注市场主体诉求，着力提高立法的针对性；突出北京特色，强化北京外商投资服务优势。

　　准入更自由

　　便利更创新

　　草案进一步明确了外商投资准入预期。据悉，北京市依法对外商投资实行准入前国民待遇加负面清单管理制度，负面清单以外的领域，外资与内资平等适用市场准入负面清单、本市新增产业禁止和限制目录，以及法律法规规定的行政许可。

　　另外，还推出了实施外资试验性政策措施。草案明确北京市利用国家服务业扩大开放综合示范区和中国（北京）自由贸易试验区，先行先试外商投资扩大开放试验性政策措施，为在更大范围复制推广积累经验。

　　值得注意的是，北京市在投资便利上进一步创新。据悉，北京市将实施数据跨境制度。依法实施外商投资企业数据出境安全评估、个人信息保护认证、个人信息出境标准合同备案等制度；市网信部门应当会同有关部门采取措施，开辟绿色通道，为符合条件的外商投资企业开展重要数据和个人信息出境安全评估，促进数据安全有序自由流动。

　　对此，北京市人大常委会民宗侨外办公室相关负责人认为，需要做进一步深入研究。“进一步促进数据跨境自由流动，要对标国家正在进行的规范和促进数据跨境流动的有关精神，就赋予自由贸易试验区制定‘负面清单’‘明确无需申报数据出境安全评估的情形’等促进数据跨境流动便捷性的内容加以规范。”

　　其次，草案支持资金可跨境流动。按照国家规定支持真实合规、与外国投资者投资有关的所有转移可自由汇入、汇出且无迟延；外商投资企业外籍职工和香港、澳门、台湾职工的工资收入和其他合法收入，可以依法自由汇出。

　　此外，草案鼓励利润再投资。鼓励外商投资企业利润再投资，实行与新增外资相同的配套政策；外商投资企业境内取得利润再投资暂不征收预提所得税政策；探索实施外商投资企业再投资免于外汇登记制度。

　　管理更优化

　　服务更完善

　　在投资管理上，草案重点在登记注册、项目备案、监管执法三方面进行优化。

　　优化登记注册。草案明确，北京市市场监管部门应当优化外商投资企业登记注册办理流程，提高登记注册效率；会同有关部门建立外商投资者身份认证数据对接验证机制，实现外商投资企业登记注册全程网上办理。市场监管部门应当支持股份有限公司因股东发生变化提出的互换内外资企业类型的变更申请。

　　优化项目备案。据悉，外国投资者、外商投资企业需要办理投资项目核准、备案的，应当向发展改革部门或者有关部门申请；对实行备案管理的项目，外国投资者、外商投资企业提交全部项目信息后即视为备案。

　　优化监管执法。草案指出，有关部门应当统筹涉外商投资企业监督检查，采取“双随机、一公开”监管与信用风险分类管理；支持统筹安全生产、环境保护、产品质量等涉企执法检查事项，实现“进一次门、查多项事”。

　　在投资服务上，两项服务和三个机制需要关注。两项服务包括“一窗受理服务”和“政策精准服务”。据悉，涉外政务服务事项实施“一窗”综合受理；有关部门依法确定涉外政务服务事项受理条件、流程和材料等，并向社会公布；健全国际化网络服务平台，为外商投资提供数字化集成服务。

　　三个机制具体为政企沟通机制、项目服务机制和多元化纠纷解决机制。根据草案，北京市政府及有关部门、区人民政府要定期召开与外商投资企业与高层的沟通交流，协调解决重点难点问题，并对提出的意见建议，商务部门应当梳理形成外商投资企业诉求清单，及时转交有关部门办理；建立健全重点外商投资项目服务机制，为重点项目洽谈、签约、注册和运营等提供全流程服务，采取服务包、管家服务等方式，统筹推进、协调落实服务事项，为外商投资企业提供个性化、精准化、日常化服务等。

　　11月22日，北京市第十六届人大常委会第六次会议审议了《北京市人民政府关于2022年度国有资产管理情况的综合报告》、听取审议了《北京市人民政府关于2022年度金融企业国有资产管理情况的专项报告》。北京商报记者在会上获悉，截至2022年末，北京市国有企业（不含金融企业）资产总额9.11万亿元，全市金融企业资产总额9.02万亿元。

　　国企资产总额达9.11万亿

　　报告全面反映了北京市2022年国有企业、国有金融企业、行政事业单位和国有自然资源等各类国有资产管理、使用、处置和监督的实际情况。

　　数据显示，截至2022年末，北京市国有企业（不含金融企业）资产总额9.11万亿元，负债总额5.97万亿元；金融企业资产总额9.02万亿元，负债总额8.12万亿元；行政事业性国有资产总额1.33万亿元，负债总额0.2万亿元。

　　另外，北京市国有土地总面积35.44万公顷，发现各类矿产129种，森林资源总面积85.57万公顷，平原区地下水埋深15.64米，自然湿地资源总面积0.3万公顷，自然保护地包括5类47处，总面积约32.62万公顷。

　　国资管理取得新成效

　　报告指出，北京市坚持“五子”联动服务和融入新发展格局，统筹推动国有资产管理改革，国有资产管理各项工作取得了新进展、新成效。

　　国有企业改革不断深化，国有企业对全市经济形成的支撑和带动作用逐步显现。扎实推进国企改革三年行动计划，全面完成全市1500多户企业的公司制改革。持续加大创新投入，强化国有企业科技创新主体地位，增强首都发展新动能。布局首钢京津冀工业互联网、北汽工业互联网等一批数字化平台，加快推进数字国企建设。

　　国有金融资本战略布局持续优化，金融企业服务实体经济能力不断提高。建立中关村科创金融服务中心，创设“京创通”“京创融”等结构性货币政策工具，有效提升科创企业融资便利度。加强政府性融资担保体系建设，加大创业担保贷款财政贴息力度，扩大政策支持范围和额度，协同联动解决中小微企业融资难题。完善现代金融监管体制建设，发挥大数据监测预警平台作用，维护首都金融安全稳定。

　　认真落实“过紧日子”要求，行政事业性国有资产综合配置效率稳步提升。认真贯彻《行政事业性国有资产管理条例》，扎实开展资产产权登记、资产清查和资产年报等基础工作，不断提升资产信息质量。深入落实节约型政府建设理念，持续推进市级行政事业单位公物仓建设，促进存量资产调剂和共享共用，高质量推动行政事业性资产管理工作。

　　自然资源保护和利用水平显著提高，国有自然资源管理效能得到充分释放。持续优化国土空间布局，强化核心区、中心城区、平原多点地区、生态涵养区等主体功能。加强自然资源调查监测体系建设，首次全面完成北京市城市国土空间监测任务。加强自然资源保护利用，推动首都环境质量持续提升，全市河湖生态健康状况持续向好、空气质量整体持续改善、全市生态环境质量指数为71.1，生态系统质量和稳定性持续提高。

　　将深化新一轮国企改革

　　展望未来，北京市将坚持“以新时代首都发展为统领，以推动高质量发展为主题”，积极谋划，开拓创新，充分发挥各类国有资产对首都经济发展的重要作用，奋力开创新时代首都发展新局面。

　　首先，将突出“战略支撑作用”，推动国有经济质量效益提升。立足加强“四个中心”功能建设，深化新一轮国企改革，加快构建现代化产业体系，推动高精尖产业链创新链更好协同发展。强化企业创新主体地位，在电子信息、高端装备制造等领域加快技术攻关。加大国有资产监管力度，强化重点领域防控，推动企业建立健全内部监督工作体系。

　　同时，突出“服务实体经济”，构建多层次金融服务体系。进一步扩大优质金融供给，满足企业多元化融资需求，助力科技型中小企业发展，为实体经济高质量发展提供有力支撑。督促金融企业履行防控金融风险的主体责任，加强防控能力建设和内控体系建设，不断提高风险管理水平，守牢不发生系统性风险的底线。

　　突出“提升配置效能”，健全部门间资产共用共享机制。深入落实行政事业性国有资产管理制度，督促行业主管部门和单位履行资产管理主体责任。强化“过紧日子”意识，持续加强资产盘活力度，健全部门间资产共用共享机制，提高资产使用效率。进一步夯实产权登记、资产清查、资产年报等工作，不断提高资产数据质量，打牢管理基础。

　　此外，下一步，北京还将突出“绿色低碳发展”，以高品质生态环境支撑高质量发展。坚持规划引领，有序推进城乡建设用地减量工作落实。支持生态涵养区生态保护和绿色发展，深入推进生态空间整体保护和系统修复,进一步强化水资源刚性约束和水安全韧性保障，持续做好森林、湿地资源保护，持续提升生态系统质量和稳定性。
